Free Website Program Terms

1. What the Free Website Program is

The Free Website Program (“Program”) is an offer where Elevare designs, builds, and hosts a website for your business at no upfront cost and no recurring subscription fee to you. In exchange, Elevare earns a platform fee on payments your site processes (Section 3).

By submitting the sign-up form and checking the acceptance box, you agree to these terms and confirm you are authorized to bind your business. The Program is offered at Elevare’s discretion — every request is reviewed and screened (Section 6), and Elevare may decline any request for any lawful reason.

2. What Elevare does and doesn’t provide

Elevare will use commercially reasonable efforts to:

• Design and build a website appropriate to the business you describe.
• Host the site and keep it reasonably available.
• Provide a private preview of the site for your review before it goes live.
• Integrate payments through Stripe on your connected account.

Elevare does not promise:

• Any specific traffic, ranking, sales, revenue, or business result.
• A specific delivery date unless separately agreed in writing.
• Custom features, integrations, or unlimited revisions beyond what Elevare reasonably scopes for a Free Website. Larger or custom work may be offered as a separate paid engagement.
• Uninterrupted or error-free hosting. Hosting is provided on a reasonable-efforts basis and may depend on third-party providers.

The scope of a Free Website is what Elevare reasonably determines is appropriate for the Program. This is not a custom agency build unless you and Elevare separately agree to one in writing.

3. The platform fee — how Elevare gets paid

Elevare earns money only through a platform fee taken on the payments your website processes. There is no upfront fee and no monthly fee to you.

3.1 Fee tiers

You choose your business model when you sign up, which sets your fee tier:

You select your model at sign-up. Elevare confirms the applicable rate with you before your site goes live. Elevare may adjust the tier to match how your site actually operates, and will tell you the confirmed rate before go-live. The confirmed fee percentage is the rate that applies to payments processed on your site.

3.2 How the fee is collected (Stripe Connect)

• Payments on your site are processed through Stripe, on your own Stripe connected account.
• Elevare’s platform fee is collected automatically by Stripe Connect as an application fee on each transaction — it comes out of the payment when it is processed. You do not receive a separate invoice from Elevare.
• Stripe’s own processing fees are separate and are governed by your agreement with Stripe (the Stripe Services Agreement), not by Elevare. Elevare does not set or control Stripe’s fees.
• The platform fee applies to payments processed through the site Elevare builds and connects. It does not apply to money you earn through other, unconnected channels.

3.3 Refunds, chargebacks, and disputes

If you refund a customer, handling of the associated platform fee follows Stripe’s standard behavior for refunded application fees. Chargebacks, disputes, and any related fees or losses are between you, your customer, and Stripe. You are responsible for fulfilling what your customers pay for.

4. Going live requires a connected Stripe account

• Your site is built to a private preview. It does not go live until you connect a Stripe account to Elevare’s platform and that account is enabled to accept charges.
• No Stripe connection, no go-live. This is how the platform fee is collected and is a non-negotiable condition of the Program.
• You are responsible for completing Stripe’s onboarding and for keeping your Stripe account in good standing. Elevare cannot complete Stripe’s verification for you.
• If Stripe restricts, suspends, or closes your account, your site’s ability to take payments — and to stay live — may be affected. That relationship is between you and Stripe.

5. The 3-month revenue condition (new clients only)

Because Elevare invests real design, build, and hosting work for $0 upfront and earns only when your site earns, the Program depends on sites that are actually used.

• Applies to: new Free Website clients only. It does not apply retroactively to existing Elevare clients on other arrangements.
• The condition: if your site generates no revenue within 3 months (90 days) of going live, Elevare may end the project and take the site down.
• We will not do this by surprise. Before any takedown under this section, Elevare will give you at least 14 days’ advance written notice (to the email you signed up with), so you have a chance to respond or start earning.
• You keep your content.Before takedown, you may export and keep the content you provided (your text, images, logo, and product/service information). Elevare’s underlying code, templates, design system, and platform are not included (see Section 7).
• This condition is a right, not an automatic action — Elevare may choose to keep hosting a slow-starting site at its discretion.

6. Eligibility, screening, and Stripe compliance

• Your business must be lawful and eligible for Stripe. Because every Free Website is monetized through Stripe, your business must be permitted under Stripe’s Prohibited and Restricted Businesses List and the Stripe Services Agreement, and must comply with all applicable laws.
• You warrant that your business is legal; you are authorized to run it and to enter these terms; and your business, products, services, and content do not fall within Stripe’s prohibited/restricted categories (for example — and not limited to — illegal goods or services, most weapons and ammunition, adult content, gambling, recreational drugs/cannabis/CBD, counterfeit goods, pyramid/MLM schemes, debt collection, or unlicensed financial or healthcare services).
• Elevare screens every request and may decline, pause, or remove any business that Elevare reasonably believes violates Stripe’s policies or applicable law, or that Stripe declines, restricts, or terminates. Onboarding a prohibited business could jeopardize Elevare’s entire payments platform and every other client on it — so Elevare enforces this strictly.
• Elevare’s screening is a business-risk decision, not legal or compliance advice to you. You remain responsible for confirming your own business is lawful and Stripe-eligible.

7. Ownership, content, and attribution

7.1 Your content

You own the content you give us — your business name, text, images, logo, and product/service information (“Client Content”). You grant Elevare a license to use, host, adapt, and display Client Content to build, host, run, and promote your site under the Program.

7.2 The site, code, and platform

The website Elevare builds (the delivered pages) is provided for your use under the Program while it is hosted by Elevare. Elevare’s underlying code, templates, design system, components, tooling, and platform remain Elevare’s property. The Program is a build-and-host service, not a sale or transfer of Elevare’s platform or source code, and does not, by itself, grant you the source code or a right to self-host, unless separately agreed in writing.

7.3 Hosting and attribution

Elevare hosts your site; availability depends on Elevare and its third-party infrastructure providers. Your site will display a “Powered by Elevare Studio LLC” credit (typically a small footer link). Keeping this credit in place is a condition of the Program.

7.4 Your responsibilities

You are solely responsible for your business and everything it does through the site, including: your products, services, pricing, offers, and claims; fulfilling customer orders and honoring bookings/deposits; all taxes on your revenue; compliance with all laws that apply to your business; and making sure you have the rights to any content, images, trademarks, or materials you give Elevare.

8. Your review responsibility

You are responsible for reviewing your site — especially your private preview — and confirming that all business-critical information (prices, offers, hours, contact details, and any legal or safety claims) is accurate before and after go-live. Elevare will correct clear build errors it is told about, but Elevare is not liable for business decisions made in reliance on content you did not review.

9. “As is” — no warranty

To the fullest extent permitted by law, the Program, your site, and hosting are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory — including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, uptime, or results. Elevare does not warrant that the site or hosting will be uninterrupted, error-free, secure, or that it will produce any particular business outcome.

10. Limitation of liability

To the fullest extent permitted by law:

• Elevare is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising out of or relating to the Program or your site — even if advised of the possibility.
• Elevare’s total aggregate liability for any and all claims relating to the Program is limited to the total platform fees Elevare actually collected from you in the 3 months before the claim. Because the Program is provided at no upfront cost, the parties agree this cap is reasonable.
• Nothing in these terms limits liability that cannot be limited by law.

11. Indemnification (you cover us for your business)

You agree to defend, indemnify, and hold harmless Elevare Studio LLC and its owners, members, and contractors from any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising out of or relating to: your business, products, services, offers, or claims; Client Content you provide, or your infringement of anyone’s intellectual-property, privacy, or other rights; your customers, orders, bookings, refunds, or disputes; your violation of law, of Stripe’s terms, or of these terms; and taxes owed on your revenue.

12. Suspension and termination

You may leave the Program at any time by telling Elevare in writing. On exit, you may export and keep your Client Content (Section 7.2), your site will be taken down, and its ability to process payments ends.

Elevare may suspend or terminate your site or the Program, with notice where reasonably practicable, if: you breach these terms; your business becomes ineligible under Stripe’s policies or the law; Stripe restricts, declines, or terminates your account; the 3-month revenue condition applies (Section 5); or continuing would expose Elevare or its platform to legal, financial, or reputational risk. Sections that by their nature should survive (fees owed, ownership, disclaimers, limitation of liability, indemnification, governing law) survive termination.

13. Data and privacy

Elevare collects the information you submit (business details, contact information) and Stripe-connection metadata to operate the Program, handled under Elevare’s Privacy Policy. Payment data is handled by Stripe under Stripe’s terms and privacy policy; Elevare does not store your customers’ full card details. You are the party responsible for any personal data your website collects from your customers (contact forms, bookings, orders), including providing your customers a privacy notice and honoring their rights under applicable privacy laws (such as GDPR, CCPA/CPRA).

14. Changes to these terms

Elevare may update these terms. If a change is material, Elevare will make reasonable efforts to notify you (for example, by email to your sign-up address or a notice in your dashboard), and may ask you to re-accept. Continuing to use the Program after a change takes effect means you accept the updated terms.

15. Dispute resolution and governing law

• Talk to us first. Before starting any formal action, you agree to contact Elevare at owner@elevarestudio.co and give the parties at least 30 days to try to resolve the issue informally, in good faith.
• Governing law and venue. These terms are governed by the laws of the state in which Elevare Studio LLC is organized, without regard to conflict-of-laws rules. The parties submit to the courts located in that state for any dispute not resolved informally.

16. General

• Entire agreement.These terms (plus any separate written agreement you sign with Elevare, and Elevare’s Privacy Policy) are the entire agreement for the Program. A separate signed agreement, if any, controls where it conflicts. The plain-English summary is a convenience and does not override the full terms.
• No partnership. Elevare is an independent service provider. Nothing here creates a partnership, joint venture, employment, or agency relationship.
• Severability. If any provision is unenforceable, the rest stays in effect.
• No waiver.Not enforcing a term once doesn’t waive it.
• Assignment.You may not assign these terms without Elevare’s consent; Elevare may assign them to a successor or affiliate.
• Contact. owner@elevarestudio.co.
