Elevare builds and hosts websites for other businesses. If you believe material on elevarestudio.co (or on a site we host for a client) infringes a copyright you own, you can send a notice to our designated agent below and we will act on it.

Designated agent

This designation is on file with the U.S. Copyright Office and appears in its public DMCA Designated Agent Directory.

Email reaches us fastest. This address is for copyright notices only. Support requests sent here will be slower to answer than through the normal channels.

What your notice needs to contain

So that we can act on it, and so it meets the requirements of 17 U.S.C. § 512(c)(3), please include all of the following:

• Your physical or electronic signature.
• Identification of the copyrighted work you say has been infringed. If several works on one page, a representative list is fine.
• The material you are asking us to remove, described precisely enough that we can actually find it. A direct URL is best.
• Your name, address, telephone number and email address.
• A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate, and (under penalty of perjury) that you are the copyright owner or authorised to act on the owner's behalf.

A notice missing these elements may not be effective, and we may come back to you for the missing parts rather than acting on it.

What we do when we receive one

We remove or disable access to the material identified, and we tell the person who published it what was removed and why, including a copy of your notice. If the material belongs to a client whose site we host, we contact that client. We do not judge the merits of a dispute between you and them.

If you believe your material was removed by mistake

You can send a counter-notice to the same agent. It must include:

• Your physical or electronic signature.
• Identification of the material that was removed, and the location it appeared at before removal.
• A statement under penalty of perjury that you believe in good faith the material was removed as a result of mistake or misidentification.
• Your name, address and telephone number.
• A statement that you consent to the jurisdiction of the Federal District Court for the district where you live (or, if you are outside the United States, the district where Elevare may be found), and that you will accept service of process from the person who filed the original notice.

We will forward your counter-notice to the person who filed the original complaint. If they do not tell us within 10 business days that they have filed a court action, we may restore the material.

Knowingly false notices carry a penalty

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing (or that it was removed by mistake) can be liable for damages, including costs and legal fees. Please be sure before you send either kind of notice.

Repeat infringers

We terminate the accounts of users, and end engagements with clients, who are repeat infringers in appropriate circumstances.

Trademarks and other complaints

The process above is for copyright. For trademark or other intellectual property concerns, write to owner@elevarestudio.co describing the mark, your rights in it, and where it appears. We handle those on the same principle: tell us precisely what to look at and we will look.
