What your notice needs to contain

So that we can act on it, and so it meets the requirements of 17 U.S.C. § 512(c)(3), please include all of the following:

What we do when we receive one

We remove or disable access to the material identified, and we tell the person who published it what was removed and why, including a copy of your notice. If the material belongs to a client whose site we host, we contact that client. We do not judge the merits of a dispute between you and them.

If you believe your material was removed by mistake

You can send a counter-notice to the same agent. It must include:

We will forward your counter-notice to the person who filed the original complaint. If they do not tell us within 10 business days that they have filed a court action, we may restore the material.

Knowingly false notices carry a penalty

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing (or that it was removed by mistake) can be liable for damages, including costs and legal fees. Please be sure before you send either kind of notice.

Repeat infringers

We terminate the accounts of users, and end engagements with clients, who are repeat infringers in appropriate circumstances.

The process above is for copyright. For trademark or other intellectual property concerns, write to owner@elevarestudio.co describing the mark, your rights in it, and where it appears. We handle those on the same principle: tell us precisely what to look at and we will look.
